Meet your mentor: Scott Alden

With over 20 years’ experience, Scott specialises as a legal advisor on significant projects and procurements for primarily government, but also private sector, clients.

Scott’s role of lead legal advisor to significant projects often incorporates legal and procurement expertise on the same transaction, as well as strategic probity advice.

In recognition of his position as a leading government lawyer, Scott was one of the first NSW Law Society Accredited Specialists in Government and Administrative Law (with a focus on government commercial and procurement transactions), and has been appointed by the Law Society of NSW as the Head Assessor for that Specialist Accreditation this year. Scott also writes and lectures two procurement courses for the Masters Programs at both the College of Law and the University of Melbourne.

Scott also has a special interest in contract law, particularly for major projects, and is a member of the Australian Advisory Board for the World Commerce and Contracting Association (previously the International Association of Contract and Commercial Management).

Scott is experienced in drafting and implementing key project documents including market sounding/engagement documents, industry briefings, RFTs, tender evaluation plans, tender evaluation reports, commercial contracts and agreements and legal advices and resolutions to support decisions.

If you are in a role that involves day-to-day procurement then this course is for you.

You will benefit from a cradle to grave analysis and walk through of procurement best practice and risk minimisation in 9 bespoke sessions designed for the procurement officer and procurement professional.

Session 1 – Setting up for success – Designing, Planning and Running your Procurement to Minimise Risk, Comply with Obligations and Maximise outcomes

The second part in the series examines the earliest stages of procurement starting with identifying what is meant by procurement, how a sourcing need arises, the importance of the business case, the procurement planning phase and developing an appropriate procurement strategy.


Session 2 – Probity in Procurement

Probity, and the observance of fairness, transparency, equality and ethical dealing is fundamentally important to any project and to the organisations that run them.

This session will focus on the five pillars of probity with a special emphasis on the two most important being Value for Money and the avoidance of Conflicts of Interest.


Session 3 – Legal Risks and Issues in Procurement

This part will focus on the legal issues and risks that present themselves when undertaking a procurement process. These include:

  • The formation of a process contract
  • Negligence, Misleading and Deceptive Conduct, and Estoppel
  • Legislative Challenge
  • Damages for breach
  • Excluding / Limiting liability
  • Preliminary Discovery
  • Some War Stories


Session 4 – Assessing Tenders – different ways to assess proposals to ensure value for money and identifying and avoiding common procurement pitfalls

In this part we examine the assessment of tenders, and the evaluation process in detail. This looks at what value for money really means, what we mean by whole of life / life cycle costing, and how we carry out an effective Multi Attribute Decision Analysis process to ensure that we properly weight and value all aspects of a procurement adopting best practice in Sustainable Procurement Decision Making. This will explain the core methodology of Sustainable Procurement including Economic, Environmental and Social Procurement.


Session 5 – Current Innovations in Procurement – New Procurement Methods – Early Contractor Involvement and Market Led (Unsolicited) Proposals

Procurement is ever changing and evolving with different, alternative and innovative procurement methods constantly emerging. This part will focus on two in particular being:

  • Early Contractor Involvement (Early Contractor Engagement/ Competitive Dialogue/ Early Tenderer Involvement)
  • Market Led Proposals / Unsolicited Proposals
  • Tenderer Negotiations


Session 6 – Managing the Procurement

Having planned a perfect procurement activity, received a variety of excellent compliant proposals, assessed the bids and identified the one that is best value for money you then need to finalise the contract and manage the contract to ensure that you receive what it is that you engaged with the market to deliver.


Session 7 – The Top Ten Procurement Issues

A round up of the hottest topics and innovations in Procurement for the year gone by.
